This website is owned and operated by Pelvic Pain Solutions International, LLC, a Florida limited liability company doing business under the brand name SunCloud^® Cushions.

In these Terms & Conditions, the terms “Company,” “SunCloud,” “SunCloud Cushions,” “we,” “us,” and “our” refer to Pelvic Pain Solutions International, LLC. The terms “you,” “your,” and “customer” refer to any person who accesses this website, creates an account, communicates with us, or purchases a product from us.

References to the “Site” include this website, its product pages, checkout pages, account areas, digital content, and related online services.

Acceptance of Terms

By accessing or using the Site, creating an account, placing an order, or clicking a button indicating your acceptance, you acknowledge that you have read, understood, and agreed to these Terms & Conditions and all policies incorporated into them by reference.

These Terms incorporate our Privacy Policy, Return and Refund Policy, Shipping Policy, and any product-specific terms displayed on the Site.

If you do not agree to these Terms, you may not use the Site or place an order.

Eligibility and Age Requirements

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to enter into a binding purchase agreement with us.

A parent or legal guardian may place an order on behalf of a minor and assumes responsibility for the purchase, use of the product, and compliance with these Terms.

By using the Site or placing an order, you represent that you have the legal authority and capacity to agree to these Terms.

Orders, Payment and Order Acceptance

Order Information

You agree to provide complete, current, and accurate information when placing an order. This includes your name, billing information, shipping address, email address, telephone number, product selection, size, material, color, firmness, and any requested customization.

You are responsible for reviewing all product selections and order details before completing checkout.

Payment Authorization

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment processors to charge the total amount shown at checkout, including applicable taxes, shipping fees, and other disclosed charges.

Payment is generally processed when the order is placed. Because our cushions are made to order, purchasing materials, scheduling production, and other preparatory work may begin shortly after payment is received.

Order Acceptance

An order confirmation does not necessarily constitute final acceptance of an order. We reserve the right, to the extent permitted by law, to reject or cancel an order for reasons including:

• Product, material, or component unavailability;
• Incorrect pricing or product information;
• Suspected fraud or unauthorized payment activity;
• Shipping restrictions;
• An inability to fulfill the requested configuration; or
• A violation of these Terms or another Company policy.

If we cancel an order after payment has been processed, we will issue an appropriate refund to the original payment method, subject to applicable law and payment-processor requirements.

Made-to-Order Products

SunCloud^® Cushions are handcrafted in small batches and produced according to the size, style, material, color, firmness, and other options selected by the customer.

Our products are not mass-produced inventory items unless a product is expressly identified as in stock, ready to ship, or part of a quick-ship collection.

Made-to-order production may involve ordering or allocating materials, cutting fabric or foam, sewing covers or liners, assembling components, and performing quality-control inspections specifically for your order.

Order Cancellations and Changes

48-Hour Cancellation Period

Orders may be canceled within 48 hours of purchase by contacting us with your name and order number.

After the 48-hour cancellation period, the order may have entered production or materials may have been allocated to it. We therefore may be unable to accept a cancellation or change request after that period.

Nothing in this section limits any cancellation, refund, or other right that cannot lawfully be waived.

Change Requests

Requests to change a product’s size, firmness, material, color, shipping address, or other specification must be submitted as soon as possible. We will make reasonable efforts to accommodate a requested change, but we cannot guarantee that changes can be completed once production or shipment preparation has begun.

Approved changes may result in additional charges or an adjusted production timeline.

Production and Shipping

Production Time

Unless otherwise stated on the applicable product page or communicated to you in writing, please allow up to 30 days for production before shipment.

The production period begins after we receive a completed order and successful payment authorization. It does not include the carrier’s transportation time after the package is shipped.

Shipping Estimates

Shipping and delivery dates are estimates rather than guarantees. Actual delivery may be affected by carrier delays, weather, holidays, address problems, regional service interruptions, or events outside our reasonable control.

We will provide shipment confirmation or tracking information when available. Tracking updates are controlled by the carrier and may not appear immediately after a label is created.

Production Delays

Delays may occasionally result from material availability, manufacturing capacity, quality-control issues, equipment problems, illness, holidays, carrier interruptions, severe weather, or other circumstances.

If we cannot ship within the timeframe represented at the time of purchase, we will communicate with you and provide any notice, revised estimate, cancellation option, or refund required by applicable law.

Shipping Address

Customers are responsible for providing a complete and accurate shipping address. Contact us immediately if an address requires correction.

We are not responsible for delays, losses, or additional carrier charges caused by an incorrect or incomplete address supplied by the customer, except to the extent required by law.

Lost, Damaged or Missing Shipments

If a package arrives damaged, appears to be missing an item, or is not received despite being marked delivered, contact us promptly. Keep the packaging and take photographs of any visible damage so that we can evaluate the issue and, when appropriate, assist with a carrier claim.

Returns, Refunds and Exchanges

Eligibility for a return, refund, exchange, replacement, or store credit is governed by the Return and Refund Policy displayed on the Site at the time of purchase.

Unless a different written policy applies, eligible return requests must be initiated within 10 days of delivery.

Returned products must satisfy the condition, authorization, packaging, and other requirements stated in our Return and Refund Policy. Certain made-to-order, personalized, clearance, final sale, hygienic, or used products may be excluded from return where permitted by law and where properly disclosed before purchase.

Customers should not send a product back without first following the return instructions provided by us.

Refund processing times may vary depending on inspection, payment processing, banking networks, and the original payment method.

Nothing in these Terms excludes rights or remedies that cannot legally be excluded.

Product Warranty

Certain eligible SunCloud^® products may include a limited foam warranty, including our 5-Year Premium Foam Warranty, when expressly stated on the product page or in the warranty documentation supplied with the product.

Warranty coverage is limited to the specific conditions, exclusions, claim procedures, documentation requirements, and remedies stated in the applicable warranty policy.

A warranty does not cover normal wear and tear, cosmetic changes, fabric damage, stains, misuse, improper cleaning, unauthorized alterations, accidents, damage caused by pets, commercial misuse, failure to follow care instructions, or changes in individual comfort preferences unless the written warranty expressly states otherwise.

The applicable written warranty controls if it conflicts with a general statement in these Terms.

Product Information and Handmade Variations

Product Descriptions

We make reasonable efforts to present accurate product descriptions, measurements, photographs, colors, materials, firmness guidance, pricing, and availability.

Product images are illustrative. The appearance of colors and textures may vary depending on screen settings, lighting, photography, material batches, and manufacturing conditions.

Handcrafted Variations

Because our products are handcrafted, minor variations may occur in dimensions, stitching, fabric placement, foam contour, firmness perception, texture, color, alignment, and finishing. Reasonable handmade variations are not necessarily defects.

Measurements and Fit

Published measurements are approximate. Customers are responsible for confirming that the selected cushion size and configuration are suitable for the intended chair, vehicle, wheelchair, travel setting, or other seating surface.

Firmness and Comfort

Comfort, pressure distribution, and perceived firmness are subjective and may vary based on body weight, anatomy, posture, seating surface, duration of use, health conditions, and personal preference.

Product guidance, quizzes, messages, or recommendations are general informational assistance and do not guarantee that a particular firmness or product will meet every customer’s needs.

Pricing and Availability Errors

We reserve the right to correct typographical, pricing, product, inventory, or availability errors. If an error affects an order, we may contact you for instructions or cancel and refund the affected order, as permitted by law.

Accounts and Security

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

You agree to notify us promptly if you believe your account or payment information has been accessed or used without authorization.

You may not impersonate another person, use false information, create an account for fraudulent purposes, or attempt to gain unauthorized access to another account or any part of the Site.

Acceptable Use of the Site

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for lawful personal shopping and informational purposes.

You may not:

• Use the Site for unlawful, fraudulent, deceptive, abusive, or harmful activity;
• Interfere with the security, availability, performance, or operation of the Site;
• Attempt to gain unauthorized access to the Site, accounts, systems, servers, or data;
• Introduce viruses, malicious code, automated attacks, or other harmful technology;
• Scrape, crawl, harvest, extract, or systematically collect Site content or customer information without written permission;
• Reverse engineer, decompile, disassemble, or attempt to derive source code from Site software except where such restriction is prohibited by law;
• Use Site content to train, develop, improve, or operate an artificial intelligence or machine-learning system without our prior written permission;
• Copy, sell, sublicense, republish, distribute, commercially exploit, or create derivative works from protected Site content without authorization;
• Submit false reviews, fraudulent claims, abusive content, spam, or content that infringes another party’s rights; or
• Use our name, trademarks, photographs, product designs, or content in a way that falsely suggests sponsorship, affiliation, authorization, or endorsement.

We may restrict, suspend, or terminate access to the Site when we reasonably believe these Terms have been violated or when necessary to protect the Company, customers, service providers, or other parties.

Intellectual Property Rights

The Site and its contents—including text, product descriptions, graphics, photographs, videos, logos, icons, page designs, layouts, product configurations, illustrations, downloadable materials, software, and other content—are owned by or licensed to Pelvic Pain Solutions International, LLC and are protected by applicable intellectual-property laws.

SunCloud® Trademark

SunCloud^®, SunCloud^® Cushions, associated logos, product names, slogans, trade dress, and related brand elements are trademarks or other intellectual property owned by Pelvic Pain Solutions International, LLC unless otherwise indicated.

No license or right to use our trademarks, copyrighted materials, product photography, proprietary designs, or other intellectual property is granted except for the limited right to access the Site for personal use under these Terms.

Unauthorized reproduction, modification, distribution, display, sale, advertising use, marketplace listing, or commercial use is prohibited.

All rights not expressly granted are reserved.

Reviews, Photographs and Other Submissions

You retain ownership of original content that you submit to us, including reviews, comments, photographs, videos, suggestions, and testimonials, subject to the license described below.

By voluntarily submitting content to us or posting content through a Site feature, you grant Pelvic Pain Solutions International, LLC a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from that content for legitimate business, marketing, advertising, promotional, and operational purposes, subject to applicable privacy and consumer-protection laws.

Where appropriate, we may identify content using your first name, initials, general location, or other information you authorized us to display. We will handle personal information according to our Privacy Policy.

You represent that:

• You own the submitted content or have permission to use it;
• The submission is accurate and based on a genuine experience;
• The submission does not infringe another party’s rights;
• The submission does not contain unlawful, defamatory, threatening, deceptive, obscene, or malicious material; and
• You have disclosed any material relationship or compensation connected with the submission when required.

We may moderate or remove content when permitted by law, but we are not obligated to publish every submission.

Third-Party Links and Services

The Site may contain links to or integrations with third-party websites and services, including payment processors, financing providers, shipping carriers, review platforms, social networks, analytics providers, and other service providers.

Third-party services are governed by their own terms, policies, and practices. We do not control and are not responsible for third-party content, availability, security, accuracy, or conduct, except to the extent responsibility cannot legally be excluded.

A link or integration does not necessarily mean that we endorse every statement, product, or service offered by the third party.

Site Availability and Corrections

We make reasonable efforts to maintain accurate and current Site information, but we do not guarantee that the Site will always be uninterrupted, secure, complete, or error-free.

We may correct errors, update information, modify Site features, perform maintenance, suspend functionality, or discontinue content at any time, subject to applicable law.

• All Site information will always be complete or current;
• A product will produce a particular health or comfort result;
• A specific firmness will be suitable for every person; or
• The Site, servers, emails, or downloadable content will always be free from harmful components.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the maximum extent permitted by law.

Limitation of Liability

To the fullest extent permitted by applicable law, Pelvic Pain Solutions International, LLC and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to the Site, an order, a product, or these Terms.

This includes, where legally permitted, damages for loss of use, lost profits, lost revenue, lost data, business interruption, personal inconvenience, or the cost of substitute products, regardless of the legal theory asserted and even if the possibility of such damages was disclosed.

To the fullest extent permitted by law, the Company’s aggregate liability arising from a particular product or transaction will not exceed the amount you paid to the Company for the product or transaction giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded, including any non-waivable consumer right.

Some jurisdictions do not permit certain liability limitations. In those jurisdictions, this section applies only to the maximum extent permitted by law.

Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Pelvic Pain Solutions International, LLC and its owners, officers, employees, contractors, agents, affiliates, licensors, and service providers from third-party claims, liabilities, damages, judgments, losses, and reasonable legal expenses arising from:

• Your unlawful or unauthorized use of the Site;
• Your material violation of these Terms;
• Your infringement of another party’s rights; or
• Content that you submit or publish through the Site.

This provision does not require you to indemnify the Company for conduct for which indemnification is prohibited by applicable law.

Legal Compliance

You agree to comply with all laws and regulations applicable to your access to the Site, purchase of products, and use of products.

We may preserve or disclose information when we reasonably believe disclosure is required by law, legal process, court order, subpoena, governmental request, fraud prevention, or the protection of legal rights and safety, subject to applicable privacy law.

Export and International Use

You may not use, export, re-export, transfer, or otherwise make available the Site or products in violation of applicable trade, export-control, sanctions, or import laws.

International customers are responsible for determining whether a product may lawfully be imported and used in their location and for paying applicable customs duties, taxes, brokerage fees, and import charges unless otherwise stated at checkout.

Governing Law and Venue

These Terms and any dispute arising from or relating to the Site, an order, a product, or the relationship between you and the Company will be governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where another law must apply and cannot lawfully be waived.

Subject to any applicable law that grants you the right to bring a claim elsewhere, the parties agree that legal proceedings will be brought exclusively in a court of competent jurisdiction located in Miami-Dade County, Florida.

Nothing in this section prevents either party from pursuing an available claim in small claims court or seeking emergency injunctive relief where legally appropriate.

Severability, Waiver and Entire Agreement

Severability

If a provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or modified to the minimum extent necessary, and the remaining provisions will remain in effect.

No Waiver

A failure or delay in enforcing a provision does not waive the right to enforce that provision or any other provision later.

Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, asset transfer, financing, or sale of all or part of the business, subject to applicable law.

Entire Agreement

These Terms, together with the policies and product-specific terms incorporated by reference, constitute the entire agreement between you and the Company regarding the subject matter addressed here and supersede prior communications on that subject.

Electronic Communications

You consent to receive order-related records, notices, disclosures, and communications electronically, including by email or through the Site, where permitted by law.

Changes to These Terms

We may revise these Terms periodically to reflect changes in our products, operations, technology, policies, or legal requirements.

The revised version will be posted on this page with an updated “Last updated” date. Changes apply prospectively from the stated effective date unless applicable law requires otherwise.

Your continued use of the Site after revised Terms become effective constitutes acceptance of those Terms. However, the terms in effect when you placed an order generally continue to govern that transaction unless a change must apply by law or you agree otherwise.
